If you are buying a new duplex in Padstow or selling the family home after a parent has passed away, your contract needs more checking than a standard sale. City Peak Conveyancing acts on both across Padstow and Padstow Heights, and explains each step before you are committed.
Buying a new duplex in Padstow
Since 1 July 2024, NSW planning rules have allowed dual occupancies on most low density residential land, and older Padstow houses on wide blocks are being replaced with duplex pairs. When you buy one half, we check:
- Whether the subdivision is registered. If the new title does not exist yet, you are buying under a contract that depends on it being created, which changes your settlement date and your risk
- Torrens or strata title. A strata duplex comes with an owners corporation, shared insurance and by-laws; a Torrens title half does not
- The occupation certificate, confirming the building can lawfully be lived in
- Home building compensation cover, which protects you if the builder cannot fix defects
- Shared walls, driveways and services, and the easements or restrictions on the title that govern them
Selling an inherited home in Padstow
Many Padstow homes have been held by one owner for decades, and when they come to sell it is often the executors or beneficiaries of an estate. Selling a deceased estate property has its own steps:
- The executor named in the will usually needs a grant of probate before they can transfer the title
- We confirm who has authority to sign the contract and give instructions
- We prepare the contract and prescribed documents so your agent can list
- Older homes can carry structures that were never approved, so we check council records and the planning certificate early
- At settlement, the proceeds are paid as the executors direct
If the estate itself is in dispute, we will tell you early and refer you to a solicitor.
Flooding and the planning certificate
Parts of Padstow fall within council's local catchment flood studies, particularly near Salt Pan Creek. Where a property is affected, the section 10.7 planning certificate says so. We explain what a flood notation means for insurance, renovations and resale before you buy.

Common questions
FAQs
Can I sell my parent's house before probate is granted?
You can usually sign a contract, but settlement generally cannot happen until the executor has authority to transfer the title. We will set the settlement date with that timing in mind.
Is a duplex on strata title worse than Torrens title?
Neither is worse, but they come with different costs and rules. We explain which applies to your contract and what it means day to day.
Do you only work in Padstow?
No. We act on property anywhere in NSW, with most of our clients across Canterbury-Bankstown. See our Bankstown page.
City Peak Conveyancing acts on NSW property only. This page is general information, not advice about your circumstances.
